1. Acceptance of Terms

By accessing or using GenerateProductPhotos ("the Service"), you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service. We may update these Terms from time to time, and your continued use constitutes acceptance of the updated Terms.

2. Description of Service

GenerateProductPhotos is an AI-powered product photography service that:

• Accepts product photographs uploaded by users
• Analyzes product characteristics using artificial intelligence
• Generates professional e-commerce product images using AI image generation
• Provides a gallery for storing and managing generated images

3. Account Registration

• You must create an account to use the Service. You can register using email/password, Apple Sign-In, or Google Sign-In.
• You must provide accurate information during registration.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 13 years old (or 16 in the European Economic Area) to use the Service.
• One person or entity may not maintain more than one account.
• You are responsible for all activity that occurs under your account.

4. Credits and Payments

4.1 Credit System

• The Service operates on a credit-based system. Each AI-generated image costs one credit.
• New accounts receive a welcome bonus of free credits.
• Additional credits can be purchased through the app.

4.2 Purchases

• Credit purchases on iOS are processed through the Apple App Store and subject to Apple's terms.
• Credit purchases on Android are processed through Google Play and subject to Google's terms.
• Credit purchases on the web are processed through Stripe.
• All prices are displayed before purchase confirmation.
• Credits are non-transferable between accounts.

4.3 Refunds

• For purchases made through the Apple App Store or Google Play Store, refund requests must be directed to Apple or Google respectively, in accordance with their refund policies.
• For web purchases made through Stripe, refund requests can be submitted to admin@generateproductphotos.com within 14 days of purchase if credits have not been used.
• Credits that have already been used for image generation are non-refundable.

5. Acceptable Use

You agree not to use the Service to:

• Upload, generate, or distribute content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable
• Generate images that infringe on third-party intellectual property rights
• Upload images you do not have the right to use
• Attempt to reverse engineer, decompile, or disassemble the Service
• Use automated systems (bots, scrapers) to access the Service
• Circumvent or attempt to circumvent the credit system
• Interfere with or disrupt the Service or its infrastructure
• Impersonate another person or entity
• Generate content depicting real people without their consent
• Use the Service for any purpose that violates applicable laws or regulations

6. Intellectual Property

6.1 Your Content

• You retain ownership of the original product photographs you upload.
• By uploading images, you grant us a limited license to process them for the purpose of providing the Service.
• You represent that you have the right to upload and use the images you submit.

6.2 Generated Images

• You receive a license to use AI-generated images for personal and commercial purposes, including e-commerce listings, marketing materials, and social media.
• Generated images are created using AI and may not be eligible for copyright protection in all jurisdictions.
• We do not guarantee that generated images will be unique or that similar images have not been generated for other users.
• You are responsible for ensuring your use of generated images complies with applicable laws and platform terms of service.

6.3 Our Intellectual Property

The Service, including its software, design, branding, AI models, prompts, and documentation, is owned by GenerateProductPhotos and protected by intellectual property laws. You may not copy, modify, or create derivative works of the Service itself.

7. AI-Generated Content Disclaimer

• Generated images are produced by artificial intelligence and may not perfectly represent your actual product.
• AI-generated images may contain inaccuracies, artifacts, or unexpected results.
• You are responsible for reviewing generated images before using them in commerce.
• We do not guarantee that generated images will meet specific quality standards or be suitable for any particular purpose.
• Product analysis results (category, dimensions, etc.) are AI estimates and should be verified by the user.

8. Service Availability

• We strive to maintain the Service's availability but do not guarantee uninterrupted access.
• The Service may be temporarily unavailable for maintenance, updates, or due to factors beyond our control.
• We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice.
• Generation times may vary depending on server load and AI processing requirements.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied.
• We do not warrant that generated images will be error-free, accurate, or suitable for your specific use case.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
• Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
• We are not responsible for any losses resulting from your reliance on AI-generated content.

10. Indemnification

You agree to indemnify and hold harmless GenerateProductPhotos, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you upload to the Service
• Your use of generated images

11. Account Termination

• You may delete your account at any time by contacting us.
• We reserve the right to suspend or terminate accounts that violate these Terms.
• Upon termination, your access to the Service and any unused credits will be revoked.
• We may retain certain data as required by law or for legitimate business purposes.

12. Third-Party Services

The Service integrates with third-party services including:

• Google Gemini AI — for image analysis and generation
• Apple and Google — for authentication and in-app purchases
• Stripe — for web payment processing

Your use of these services is subject to their respective terms and policies. We are not responsible for the practices or availability of third-party services.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and GenerateProductPhotos regarding the use of the Service.
